For this project Dr. Steward was retained to provide an analysis of the ‘punch data’ when a phlebotomist at Quest Diagnostics signed in and out of work in regards to the plaintiffs’ class action complaint and motion for class certification. The data analyzed included over 1 million observations consisting of unique employees punching on and off the clock as shifts begin and end and as meal breaks are taken. Based on his review and analysis of the ‘punch data’ case documents and deposition testimony Dr. Steward analysis explored meal periods in relation to on- and off-the-clock work. Dr. Steward’s data analysis included: aggregating the number of unique employees represented in the data multiplied by the number of days each employee worked; supplanting original punches with corrected punches; studying shift lengths; and examining meal period frequency and the lack of documentation of meal periods in the data.
