In this case the EEOC alleged that the essentially 100% Hispanic supervisor workforce discriminated against African-American applicants. Working as defense statistical experts in this case Dr. Steward was retained to provide a rebuttal to the EEOC’s statistical analysis in this failure-to-hire lawsuit. In his rebuttal report Dr. Steward showed that the employment data relied upon by the EEOC in their analysis was of questionable quality and incomplete. Moreover Dr. Steward’s research revealed that the comparison hiring pools used by the EEOC were inappropriate and not applicable to the firm’s actual employment hiring pool. Finally Dr. Steward showed that the EEOC’s statistical analysis was methodologically flawed because the EEOC’s statistician made no attempt to incorporate a number of key hiring factors such as degree of job interest into their analysis.
