In this case, the plaintiffs’ allege that the defendant discriminated against African-Americans in their hiring process. Dr. Steward provided a statistical analysis of the defendant’s hiring data at the Davenport Iowa locations to determine if the population of African-American employees is consistent with the population of African-Americans in the Quad City area. Dr. Steward analyzed the sales truck driver warehouse and clerical hires Von Maur made in the Davenport during the relevant time period. To perform the analysis he utilized information on employees human resource documents labor market data and U.S. Census Bureau data. Proxies for Von Maur’s relevant applicant pool were constructed by weighting the U.S. Census Bureau demographic data by the geographical area in which Von Maur hires resided. The census data is weighted by multiplying it by the percentage of defendant hires from the appropriate geographical area. Dr. Steward’s analysis concluded that the defendant’s hiring of African-American employees was consistent with the population of African-Americans in the Quad City area and is in line with what would be expected in a race neutral employment selection process.
