In this lawsuit the plaintiff alleged he was discriminated against in a job transfer because of his race (African-American). He also contended that Texas Department of Criminal Justice (TDCJ) had a pattern of terminating African-American employees. In this case Dr. Steward reviewed the agency’s organizational structure reduction in force selection policies the selection criteria for the RIF and the transfer selection process. In contrast to the plaintiff’s allegations Dr. Steward found no statistical evidence of a bias against African-Americans in the termination or transfer process. In fact he found African-American TDCJ employees were actually terminated at a lower rate than White employees.
