In this case Dr. Steward was retained to perform an economic analysis regarding actions taken by the defendant abiding by the guidelines in the TDCJ’s written discipline policy. Dr. Steward additionally provided a statistical analysis of whether the disciplinary actions taken were consistent with an unbiased and neutral disciplinary process. He reviewed TDCJ’s “Guidelines for Disciplinary Actions” which outline disciplinary options depending on the level of the violation and the number of prior violations an employee has committed. In his analysis Dr. Steward examined the previous violations of the plaintiff and the disciplinary action taken in each instance. He performed a statistical analysis of the disciplinary rates and discipline imposed by reviewing employee discipline rates expressed as a percentage of the relevant protected group for female employees compared to male employees and white employees compared to African-American employees. He additionally reviewed rates at which certain disciplines were imposed based on the severity of violations.
