Dwight Steward Ph.D. was retained in this matter to perform an economic damage analysis and a critique of the opposing expert report. In this case the plaintiffs have alleged they incurred economic damages as a result of an automobile accident in which the plaintiff was injured. In his report Dr. Steward expresses his opinion that if economic damages are relevant in this case that the opposing expert has significantly overstated them. Dr. Steward shows that the opposing economic expert’s report significantly overstates the amount that the plaintiff could have been expected to earn had she not been injured. He also points out that the opposing expert report understates the amount that the plaintiff can now be expected to earn taking into account the injury. The earnings data for the plaintiff illustrates that the plaintiff’s future earnings capacity is not significantly different from the earnings capacity that she would have had had she not been injured.
