In this class action gender discrimination lawsuit Dr. Steward was retained by defense counsel to analyze the allegations that female managers were both under promoted and under compensated by the employer. In this case the plaintiffs retained a statistician to analyze the promotion and compensation rates of female managers. Dr. Steward showed that even assuming that the opposing expert’s model was appropriate which it was not correcting the fatal defects in his promotion and salary model produced results that were in no way suggestive of a discrimination against female managers. In fact once the problems with the plaintiffs’ statistical model were corrected the plaintiffs’ pay and promotion models actually suggested that the alleged disparities were even smaller in magnitude than Dr. Steward had previously estimated. In this case the court in their unpublished opinion cited Dr. Steward’s statistical work and ultimately denied the plaintiffs motion for class certification.
