In Mercieca v. Microsoft, the plaintiff was an Original Equipment Manufacturer (OEM) Account Manager for the defendant Microsoft. The plaintiff alleged that as a result of the cessation of his employment with the defendant, he incurred both front and back pay wage losses.
In our analysis, we performed a thorough investigation into the availability of similar positions in the labor market. Our analysis also closely reviewed the plaintiff’s search for replacement employment, as well as examined the plaintiff’s mitigation efforts. Dr. Dwight Steward testified live at trial regarding these issues.
